Article 88

Presidents are not the only group defying the law. The Army has suspended a Wisconsin training base’s first female commander after discovering portraits of President Donald Trump and Defense Secretary Pete Hegseth had been flipped around to face a wall. Contempt toward officials under Article 88 of the UCMJ takes place when a commissioned officer of the United States Armed Forces uses contemptuous words against officials of any branch of the U.S. government or any state government. Yes, retired military officers are subject to Uniform Code of Military Justice (UCMJ), including Article 88, which criminalizes contemptuous words against certain officials. This means they can be court-martialed for violations of the UCMJ, even while retired, although the extent of their freedom of speech is a subject of debate
